The use of FORD SOFTWARE is licensed, not sold. All rights reserved.
- MS SOFTWARE and/or FORD SOFTWARE may interface with and/or communicate with, or be subsequently updated to interface with and/or communicate with, other software and/or systems provided by third-party software and service providers. The use of THIRD-PARTY SOFTWARE is licensed, not sold. All rights reserved.
- MS SOFTWARE, FORD SOFTWARE and THIRD-PARTY SOFTWARE are hereinafter referred to individually and collectively as the "SOFTWARE".
The software license of this EULA grants the following:
- The user is authorized to use the software as installed on the device and as an interface with systems and services provided by or through Ford Motor Company or third-party software and service providers.
- Speech recognition: if the SOFTWARE includes one or more speech recognition components, the user must bear in mind that speech recognition is an inherently statistical process and that recognition errors may therefore occur. Neither FORD MOTOR COMPANY nor any of its suppliers can be held liable for any damage resulting from errors occurring during the speech recognition process.
- Restrictions on Reverse Engineering, Decompilation and Disassembly: the user may not reverse engineer, decompile or disassemble the SOFTWARE, nor permit others to do so, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding these restrictions.
- Restrictions on Distribution, Reproduction, Modification and Creation of Derivative Works: the user may not distribute, reproduce, modify or create derivative works based on the SOFTWARE, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding these restrictions.
- Single EULA: the end-user documentation relating to the DEVICE and related systems and services may contain multiple EULAs, as well as multiple translations and/or various support versions (e.g., in the user documentation and in the software). Even if multiple EULAs are received, the user is authorized to use only one (1) copy of the SOFTWARE.
- Transfer of the SOFTWARE: the user may transfer the rights granted under this EULA only in connection with the sale or transfer of the DEVICE, provided that no copies are retained, that all of the SOFTWARE is transferred (including all components, media, printed materials, any updates and, where applicable, the Certificate(s) of Authenticity), and that the recipient agrees to the terms of this EULA. If the SOFTWARE is an update, any transfer must include all prior versions of the SOFTWARE.
- Termination: without prejudice to other rights, FORD MOTOR COMPANY or MS may terminate this EULA if the user fails to comply with its terms and conditions.
- Security/Digital Rights Management Updates: content owners use the WMDRM technology built into the DEVICE to protect their intellectual property, including copyright-protected content. Parts of the SOFTWARE on the DEVICE use WMDRM software to access WMDRM-protected content. If the WMDRM software fails to adequately protect the content, content owners may ask Microsoft to disable the SOFTWARE's ability to use WMDRM to play or reproduce protected content. This does not affect unprotected content. By downloading licenses for protected content via the DEVICE, the user agrees to any revocation list that Microsoft may issue. Content owners may require the user to update the SOFTWARE on the DEVICE to access their content. If the user does not update, the user will not be able to access content that requires an update.
- Consent to use of data: the user agrees that MS, Microsoft Corporation, FORD MOTOR COMPANY, third-party software and system suppliers, their affiliates and/or authorized representatives may collect and use technical information gathered in any manner in connection with product support services related to the SOFTWARE or related services. The user acknowledges and agrees that MS, Microsoft Corporation, FORD MOTOR COMPANY, third-party software and system suppliers, their affiliates and/or authorized representatives may automatically check the version of the SOFTWARE and/or its components currently in use, and that they may provide updates or supplements to the SOFTWARE that are automatically downloaded to the DEVICE in the user's possession.
- Additional software/services: the SOFTWARE may allow FORD MOTOR COMPANY, third-party software and system suppliers, MS, Microsoft Corporation and their affiliates and/or authorized representatives to provide or make available to the user updates, supplements, add-on components of the SOFTWARE or Internet-based service components of the SOFTWARE after the date the user first receives the SOFTWARE ("Add-on Components").
If MS, Microsoft Corporation, third-party software and service suppliers and/or authorized representatives provide or make available to you Add-ons without additional EULA terms being established together with these Add-ons, the terms set out in this EULA apply, except where MS, Microsoft Corporation or the affiliated entity providing the Add-on(s) is the licensor of said Add-ons.
FORD MOTOR COMPANY, MS, Microsoft Corporation, their affiliates and/or authorised representatives reserve the right to discontinue, without any liability, the provision of internet-based services provided or made available to you through the use of the SOFTWARE.- Links to third-party sites: MS SOFTWARE may allow links to third-party sites through use of the SOFTWARE. Important Safety Information for Microsoft Windows Mobile for Automotive
This Ford SYNC system contains software licensed to the manufacturer FORD MOTOR COMPANY by an affiliate of Microsoft Corporation under a separate license agreement. Any removal, reproduction, reverse engineering or other unauthorized use of the software of this system in violation of the license agreement is strictly prohibited and subject to legal action.Read and follow instructions: before using the Windows Automotive system, read and strictly follow all instructions and safety information contained in this End User Manual ("User Guide"). Failure to observe the precautions contained in this User Guide may cause accidents or other serious consequences.
Keep the User Guide in the vehicle: if kept in the vehicle, the User Guide is a ready reference for you and for other users who are unfamiliar with the Windows Automotive system. Before using the system for the first time, make sure that all persons concerned have had access to the User Guide and have carefully read the instructions and safety information it contains.DANGER
Using certain system components while driving may distract the driver from traffic, with the risk of causing accidents or other serious consequences. Do not change system settings or enter data by non-voice means (using your hands) while driving. Stop the vehicle in a safe place and in compliance with applicable regulations before carrying out these operations. This is especially important when setting or changing functions that could distract the driver's attention from the road and cause the driver to take their hands off the steering wheel.General operation
Voice control: functions provided by the Windows Automotive system that can be operated only by issuing voice commands. Using voice commands while driving allows you to operate the system without taking your hands off the steering wheel.Prolonged screen viewing: do not access any function that requires prolonged viewing of the screen while driving. Pull over safely and in compliance with applicable regulations before accessing a system function that requires prolonged screen viewing. Even brief occasional glances at the screen can be dangerous if they distract you from normal driving operations at critical moments.
Volume adjustment: do not raise the volume excessively. Keep the volume at a level that still allows you to hear outside traffic noise and emergency signals while driving. Driving in conditions where these sounds cannot be heard may cause accidents.Use of voice recognition functions: voice recognition software is an inherently statistical process and may therefore be subject to errors. You are responsible for monitoring the speech recognition functions contained in the system and for correcting any errors.
