The menu structure of the SYNC navigation system is clearly organized. This chapter guides you through the main menu, settings and destination entry. It explains how map sections are adjusted and points of interest are quickly found. Supplemented by notes on route preview and map view.

END USER LICENSE AGREEMENT (EULA) FOR VEHICLE SOFTWARE

  • You ("You" or "Your") have acquired a vehicle equipped with various devices, including SYNC® and various control modules ("DEVICES"); these devices contain software licensed by or owned by Ford Motor Company and its affiliated companies ("FORD MOTOR COMPANY"). These FORD MOTOR COMPANY software products and associated media, printed materials and "online documentation" or electronic documentation ("SOFTWARE") are protected by international intellectual property laws. The SOFTWARE is licensed, not sold. All rights reserved.
  • The SOFTWARE may work and/or communicate with other software and/or other FORD MOTOR COMPANY systems in a network, or may be updated later to be linked to or communicate with additional FORD MOTOR COMPANY software and/or systems.

IF YOU DO NOT AGREE TO THIS END USER LICENSE AGREEMENT ("EULA"), DO NOT USE THESE DEVICES OR COPY THE SOFTWARE. BY USING THE SOFTWARE IN ANY WAY, INCLUDING WHEN USING THE DEVICES, YOU AGREE TO THIS EULA (OR CONFIRM AN EARLIER AGREEMENT).

GRANT OF SOFTWARE LICENSE:

This EULA grants the following license:

  • You may use the SOFTWARE as installed on the DEVICES and together with systems and/or services provided or rendered by FORD MOTOR COMPANY or by third-party software and service providers.

Description of Other Rights and Limitations

  • Speech recognition: If the SOFTWARE contains speech recognition component(s), you should understand that speech recognition is inherently a statistical process and that recognition errors are inherent in it. Neither FORD MOTOR COMPANY nor its suppliers can be held liable for damages resulting from errors in the speech recognition process.

It is your responsibility to monitor the speech recognition functions integrated in this system.

  • Restrictions on reverse engineering, decompilation and disassembly: You may not reverse engineer, decompile, translate or disassemble the SOFTWARE, or attempt to discover its source code or the underlying concepts or algorithms, and you may not permit other parties to reverse engineer, decompile or disassemble the SOFTWARE, except and only to the extent that this is expressly permitted by applicable law notwithstanding this restriction, or to the extent permitted by the license terms governing the use of open source components integrated into the SOFTWARE.
  • Restrictions on distribution, copying, modification and creation of derivative works: You may not distribute, copy or modify the SOFTWARE, or create derivative works based on the SOFTWARE, except and only to the extent that this is expressly permitted by applicable law notwithstanding this restriction, or to the extent permitted by the license terms governing the use of open source components integrated into the SOFTWARE.
  • Single EULA: The end user documentation for the DEVICES and related systems and services may contain several EULAs, for example different translations and/or media versions (e.g. in the user documentation and in the software). Even if you receive several EULAs, you are only authorized to use one (1) copy of the SOFTWARE.
  • Transfer of the SOFTWARE: You may transfer your rights under this EULA only as part of a sale or transfer of the DEVICES, provided you retain no copies and you transfer the complete SOFTWARE (including all components, media, printed materials, updates and, if applicable,
  • certificates of authenticity), and the recipient accepts the terms of this EULA. If the SOFTWARE is an update, any transfer must include all prior versions of the SOFTWARE.

  • Termination: Without prejudice to other rights, FORD MOTOR COMPANY may terminate this EULA if you do not comply with its terms.
  • Web-based service components: The SOFTWARE may contain components that enable and include certain web-based services.
  • You acknowledge and agree that FORD MOTOR COMPANY and third-party software and service providers, their associated partners and/or their authorized representatives automatically check the version of the SOFTWARE and/or its components you use, and that they may, where applicable,

provide updates and additions to the SOFTWARE that are downloaded automatically to your DEVICES.

  • Additional software/services: The SOFTWARE may allow FORD MOTOR COMPANY, third-party software and service providers, their associated partners and/or their authorized representatives to make available to you SOFTWARE updates, additions, add-on components and web-based service components for the SOFTWARE after you have received your initial copy of the SOFTWARE ("Supplemental Components"). Your internet service provider may charge you additional fees for SOFTWARE updates.
  • If FORD MOTOR COMPANY or owners of third-party software, or service providers, supply or provide Supplemental Components without a separate EULA, the terms of this EULA apply. FORD MOTOR COMPANY, its associated partners and/or its authorized representatives reserve the right to discontinue the web-based services made available to you through use of the SOFTWARE, without any liability arising from this.

  • Links to third-party websites: The SOFTWARE may offer you the option of accessing third-party websites via links.
  • These third-party websites are not under the control of FORD MOTOR COMPANY, its affiliates and/or its authorized representatives. Neither FORD MOTOR COMPANY nor its affiliates and/or authorized representatives are responsible for (i) the content of third-party websites, links on third-party websites, or changes or updates to third-party websites, or (ii) webcasting or any other form of data transmission from third-party websites. If the SOFTWARE contains links to third-party websites, these links are provided for convenience only; their inclusion does not imply any endorsement of the websites concerned by FORD MOTOR COMPANY, its affiliates and/or its authorized representatives.
  • Responsible Driving Obligation: You acknowledge your obligation to drive responsibly and to pay full attention to traffic conditions. You agree to read and follow the safety-related operating instructions for the DEVICES in particular, and you agree that you assume all risk associated with using the DEVICES.
  • UPDATES AND RECOVERY MEDIA: If the SOFTWARE is supplied by FORD MOTOR COMPANY separately from the DEVICES, on media such as a ROM chip, CD-ROM, by download from the Internet or in another way, and is marked "For Update Only" or "For Recovery Only", you may install one (1) copy of that SOFTWARE on the DEVICES as a replacement copy of the existing SOFTWARE, and use it only in accordance with this EULA and, where applicable, the terms of any additional EULA accompanying the SOFTWARE update.

INTELLECTUAL PROPERTY RIGHTS: All title and intellectual property rights in and to the SOFTWARE and its components (including, but not limited to, images, photographs, animations, video, audio, music, text and "applets" incorporated into the SOFTWARE), the accompanying printed materials and copies of the SOFTWARE are owned by FORD MOTOR COMPANY or its suppliers and partners. The SOFTWARE is licensed, not sold. Copying the printed materials accompanying the SOFTWARE is not permitted.

All title and intellectual property rights in content that may be accessed through use of the SOFTWARE are the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties.

This EULA grants you no rights to use such content beyond the intended use. All rights not expressly granted under this EULA are reserved by FORD MOTOR COMPANY, its partners, and third-party software and service providers. The use of online services that may be accessed through this SOFTWARE may be subject to applicable terms and usage restrictions for such services. If this SOFTWARE contains documentation only in electronic form, you may print one copy of that electronic documentation.

EXPORT RESTRICTIONS: You acknowledge that the SOFTWARE is subject to U.S. and EU export restrictions. You agree to comply with all international and national laws applicable to the SOFTWARE, including U.S. export laws and regulations and end-user, end-use and destination restrictions imposed by the U.S. government and other governments.

TRADEMARKS: This EULA grants you no rights in connection with the trademarks or service marks of FORD MOTOR COMPANY, its partners, or third-party software and service providers.

PRODUCT SUPPORT: For product support for the DEVICES, refer to the instructions provided by FORD MOTOR COMPANY in the documentation, such as the vehicle owner's manual.

If you have questions regarding this EULA or wish to contact FORD MOTOR COMPANY for any other reason, use the addresses provided in the documentation for the DEVICES.

Exclusion of Certain Damages: EXCEPT AS REQUIRED BY LAW, FORD MOTOR COMPANY, THIRD-PARTY SOFTWARE AND SERVICE PROVIDERS, AND THEIR PARTNERS ASSUME NO LIABILITY FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE SOFTWARE OR ITS USE OR PERFORMANCE. THIS LIMITATION APPLIES EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. EXCEPT FOR THE WARRANTIES EXPRESSLY PROVIDED FOR YOUR NEW VEHICLE, NO OTHER WARRANTIES ARE GIVEN.

SYNC® – Important Automotive Safety Information – Read and Follow Instructions:

    • Before using your SYNC® system, read and follow all instructions and safety information in this End User Guide ("Owner's Guide"). Failure to follow the precautions in the Owner's Guide may result in accidents and other serious consequences.

    General Operation

    • Voice Command Control: Certain functions within the SYNC® system can be controlled by voice commands.

Using voice commands while driving allows you to operate the system without taking your hands off the steering wheel or your eyes off the road.

  • Extended Viewing of Screen Displays: Do not access functions that require extended viewing of the screen while driving. Stop safely and legally before attempting to access a system function that requires extended attention.
  • Volume Setting: Do not raise the volume excessively. Keep the volume at a level that allows you to hear traffic noise and emergency signals while driving. Driving without being able to hear these sounds may cause an accident.
  • Navigation Functions: Any navigation features included in this system are designed to give turn-by-turn instructions to guide you to your destination.
  • Make sure that everyone who uses this system reads and follows the instructions and safety information carefully.

  • Risk of distraction: Some navigation functions may require manual (i.e., non-voice) input. Attempting to make such settings or enter data while driving can seriously reduce your attention to traffic and may cause an accident or other serious consequences. Before attempting these actions, stop the vehicle in a safe and legal manner.
  • Your judgment takes priority: All navigation functions are intended as a driving aid only.
  • Always base your driving decisions on the traffic situation and applicable traffic regulations. These features are not a substitute for your own judgment. Route suggestions from this system cannot in any way replace local traffic regulations, your own judgment, or your knowledge of safe driving.

  • Traffic safety: Never follow guidance instructions if they would result in unsafe or illegal maneuvers, if you would be placed in an unsafe situation, or if you would be guided into an area that is not considered safe.
  • Ultimately, the driver is responsible for the safe operation of the vehicle and must therefore decide for themselves whether it is safe to follow the instructions given.

  • Possible map inaccuracies: Maps used by this system may be incorrect due to road changes, traffic routing, or driving conditions.
  • Therefore, always use common sense when following route guidance.
  • Rescue and emergency services: Do not rely on the navigation functions of the system to guide you to rescue and emergency service locations. Ask local authorities or a rescue service about these locations. The map database for such navigation functions may not necessarily include all rescue and emergency services, such as police stations, fire stations, hospitals, and clinics.
  • Your Obligations and Assumption of Risk

    • You agree to the following: (a) Any use of the SOFTWARE while driving an automobile or other vehicle in violation of applicable law or otherwise compromising traffic safety presents a significant risk of inattentive driving and must therefore be avoided under all circumstances; (b) Using the SOFTWARE at excessive volume presents a significant risk of hearing damage and should therefore be avoided under all circumstances; (c) The SOFTWARE may be incompatible with new or other versions of an operating system, third-party software, or third-party services, and the SOFTWARE may cause a serious malfunction in an operating system or in third-party software or services; (d) Third-party services accessed through the SOFTWARE, as well as third-party software used together with the SOFTWARE, (i) may result in additional access fees, (ii) may not function properly, uninterrupted, or error-free, (iii) may change streaming formats or be discontinued, (iv) may contain offensive, insulting, or adult content, and (v) may contain inaccurate, false, or misleading traffic, weather, financial, or safety information or other content; and (e) Additional charges may be imposed by your mobile carrier when using the SOFTWARE, and any data volume or time counters integrated into the software are for reference purposes only; no warranty is given for these counters, and they are not designed to be a reliable source of information.
    • With respect to your use of the SOFTWARE, you agree to assume all liability and all risk relating to the items in sections (a) through (e) set out above.

    Warranty Disclaimer

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE DEVICES AND THE SOFTWARE IS AT YOUR SOLE RISK, AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, COMPATIBILITY, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE AND ALL THIRD-PARTY SOFTWARE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND FORD MOTOR COMPANY HEREBY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, THIRD-PARTY SOFTWARE, AND THIRD-PARTY SERVICES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. FORD MOTOR COMPANY DOES NOT WARRANT (a) THAT THE OPERATION OF THE SOFTWARE, THIRD-PARTY SOFTWARE, OR THIRD-PARTY SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, (b) THAT THE SOFTWARE, THIRD-PARTY SOFTWARE, OR THIRD-PARTY SERVICES WILL MEET YOUR REQUIREMENTS, (c) THAT THE OPERATION OF THE SOFTWARE, THIRD-PARTY SOFTWARE, OR THIRD-PARTY SERVICES WILL BE UNINTERRUPTED AND ERROR-FREE, OR (d) THAT DEFECTS IN THE SOFTWARE, THIRD-PARTY SOFTWARE, OR THIRD-PARTY SERVICES WILL BE CORRECTED. ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY FORD MOTOR COMPANY OR ITS AUTHORIZED REPRESENTATIVES SHALL NOT CREATE A WARRANTY.

THIRD-PARTY SOFTWARE OR THIRD-PARTY SERVICES WILL MEET YOUR REQUIREMENTS, (c) THAT THE OPERATION OF THE SOFTWARE, THIRD-PARTY SOFTWARE OR THIRD-PARTY SERVICES WILL BE UNINTERRUPTED AND ERROR-FREE, OR (d) THAT ERRORS IN THE SOFTWARE, THIRD-PARTY SOFTWARE OR THIRD-PARTY SERVICES WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY FORD MOTOR COMPANY OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY.

SHOULD THE SOFTWARE, THIRD-PARTY SOFTWARE OR THIRD-PARTY SERVICES PROVE TO BE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THE ONLY WARRANTY GRANTED BY FORD MOTOR COMPANY IS SET FORTH IN THE WARRANTY INFORMATION, WHICH IS PART OF THE OWNER'S MANUAL. IF THE TERMS OF THIS SECTION AND THE TERMS IN THE WARRANTY BOOKLET CONFLICT, THE TERMS IN THE WARRANTY BOOKLET SHALL PREVAIL.

    Governing Law, Venue, Jurisdiction

    • This EULA and your use of the SOFTWARE are governed by the laws of the State of Michigan, USA. Your use of the SOFTWARE may also be subject to other municipal, state, national or international laws.
Any legal dispute arising out of or in connection with this EULA shall be brought and tried exclusively before a court of the State of Michigan, seated in Wayne County, or in the United States District Court for the Eastern District of Michigan. You hereby agree to submit to the personal jurisdiction of a court of the State of Michigan, seated in Wayne County, and of the United States District Court for the Eastern District of Michigan in any legal dispute arising out of or in connection with this EULA.

Binding Arbitration and Class Action Waiver

    (a) Scope. This section applies to any dispute; HOWEVER, IT DOES NOT INCLUDE DISPUTES RELATING TO INFRINGEMENT OR TO THE ENFORCEMENT OR VALIDITY OF YOUR INTELLECTUAL PROPERTY RIGHTS OR THE INTELLECTUAL PROPERTY RIGHTS OF FORD MOTOR COMPANY OR ITS LICENSORS. The term dispute refers to any dispute, claim or other controversy between you and FORD MOTOR COMPANY (excluding the exceptions described above) relating to the SOFTWARE (including the price of the SOFTWARE) or this EULA, whether based on contract law, warranty, tort, statute, regulation, ordinance or any other legal or equitable theory.

THE ENFORCEMENT OR VALIDITY OF YOUR INTELLECTUAL PROPERTY RIGHTS OR THE INTELLECTUAL PROPERTY RIGHTS OF FORD MOTOR COMPANY OR ITS LICENSORS.

    (b) Notice of Dispute. In the event of a dispute, you or FORD MOTOR COMPANY must send the other party a "Notice of Dispute"; this is a written notice stating the name, address and contact information of the complaining party, the basis of the claim and the relief sought. You and FORD MOTOR COMPANY shall endeavor to resolve any dispute through informal negotiations within 60 days after the Notice of Dispute is sent. After 60 days, you or FORD MOTOR COMPANY may initiate arbitration.

    (c) Small Claims Court. You may also bring any dispute before a small claims court in your place of residence or at the headquarters of FORD MOTOR COMPANY, provided the dispute meets all requirements for a hearing before such a court.

You may bring an action in small claims court even if the disputed matter was not previously negotiated informally.

    (d) Binding Arbitration. If you and FORD MOTOR COMPANY are unable to resolve a dispute through informal negotiations or in small claims court, all further steps to resolve the dispute shall be conducted exclusively by binding arbitration. You waive the right to have disputes decided in court by a judge or jury (or to bring them as a named or class plaintiff). Instead, every dispute shall be decided by a neutral arbitrator, whose decision shall be final, except for the limited right of appeal under the Federal Arbitration Act. Any court with jurisdiction over the parties may enforce the arbitrator's award.

    (e) Class Action Waiver. Any proceeding to resolve a dispute, regardless of forum, shall be conducted solely on an individual basis between the parties. Neither you nor FORD MOTOR COMPANY shall attempt to bring a dispute as a class action, as a private attorney general action or in any other proceeding in which a party acts or proposes to act on behalf of others. Neither arbitration awards nor other proceedings shall be consolidated with one another unless both parties have given their prior written consent to all affected awards and proceedings.

    (f) Arbitration. Each arbitration shall be conducted by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. If you use the SOFTWARE as an individual for personal purposes or in the vehicle, or if the amount in dispute does not exceed $75,000, regardless of whether you are an individual and how you use the SOFTWARE, the AAA Consumer Arbitration Supplementary Rules also apply. To initiate arbitration, submit the "Commercial Arbitration Rules Demand for Arbitration" form to the AAA.

Under the AAA rules, you may request a telephone or in-person hearing. For any dispute with an amount in controversy of up to $10,000, the hearing shall be conducted by telephone, unless the arbitrator finds good cause for an in-person hearing. For further information, visit adr.org or call 1-800-778-7879. You agree to initiate arbitration only at your place of residence or at the headquarters of FORD MOTOR COMPANY. The arbitrator may award you individually the same damages as a court could. The arbitrator may grant you injunctive relief or a declaratory judgment only for you personally and only to the extent necessary to provide relief for your individual claim.

    (g) Arbitration Fees and Incentives.

    • I. Claims of $75,000 or less. FORD MOTOR COMPANY will promptly reimburse your filing fee and pay the AAA's and arbitrator's fees and expenses. If you reject FORD MOTOR COMPANY's last written settlement offer made before an arbitrator is appointed ("last written offer"), proceed with the arbitration through to the arbitrator's decision (the "award"), and the arbitrator awards you an amount greater than the last written offer, FORD MOTOR COMPANY will provide you with the following three incentives: (1) payment of the amount awarded by the arbitrator, but no less than $1,000; (2) payment of twice your reasonable attorney's fees, if any; and (3) reimbursement of all expenses (including fees and costs for experts) that your attorney reasonably incurs in investigating, preparing and pursuing your claim in arbitration. The amounts will be determined by the arbitrator.
    • ii. Claims over $75,000. The payment of filing fees and the AAA's and arbitrator's fees and expenses is governed by the AAA Rules.
    • iii. Claims of any amount. In any arbitration you initiate, FORD MOTOR COMPANY will seek reimbursement of the fees and expenses it paid to the AAA or the arbitrator, and of your filing fee that it reimbursed, only if the arbitrator determines that the arbitration was frivolous or improper.

In any arbitration initiated by FORD MOTOR COMPANY, FORD MOTOR COMPANY will pay every filing fee and all fees and expenses of the AAA and the arbitrator. FORD MOTOR COMPANY will not seek reimbursement from you of its attorney's fees and expenses in any arbitration.

Fees and expenses are not taken into account when determining the amount in dispute of a dispute.

    (h) Claims must be brought within one year. To the extent permitted by law, any claim or cause of action relating to this EULA to which this section applies must be brought within one year in small claims court (Section c) or arbitration (Section d).

The one-year period begins on the date the claim or cause of action first could be brought.

If such a claim or cause of action is not brought within one year, it is permanently barred.

    (i) Severability. If the class action waiver (Section e) is found to be unlawful or unenforceable as to all or part of a dispute, the provisions of Section e will not apply to those parts. Those parts will instead be severed and litigated in a court of competent jurisdiction, while the remaining parts will be arbitrated. If any other provision of Section e is found to be unlawful or unenforceable, that provision will be void, and the remainder of Section e will remain in effect.

Telenav Software End User License Agreement

Please read these terms carefully before using the TeleNav Software. By using the TeleNav Software, you confirm that you accept these terms. If you do not agree to these terms, do not open the sealed packaging of the TeleNav Software, and do not install or otherwise use the TeleNav Software. TeleNav reserves the right to change this Agreement and the Privacy Policy at any time, with or without notice. You agree to regularly visit http://www.telenav.com to review the current version of this Agreement and the Privacy Policy.

    1. Safe and Lawful Use

You acknowledge that using the TeleNav Software may create a risk of injury or death to you and others in situations that otherwise require your full attention, and you therefore agree to follow these instructions when using the TeleNav Software:

    (a) obey all traffic laws and drive safely;

    (b) while driving, use your own judgment. If you believe that a route suggested by the TeleNav Software directs you to perform an unsafe or illegal maneuver, places you in an unsafe situation, or directs you into an area you consider unsafe, do not follow those instructions;

    (c) enter destinations and otherwise operate the TeleNav Software only when your vehicle is stopped and parked;

    (d) do not use the TeleNav Software for illegal, unauthorized, unintended, unsafe, dangerous or unlawful purposes, or in any manner that violates the terms of this Agreement;

    (e) securely mount all GPS and radio-controlled devices and cables that you need to use the TeleNav Software in your vehicle so that they do not distract you while driving and do not interfere with the operation of safety devices (e.g., airbags).

You agree to indemnify and hold TeleNav harmless from all claims arising from dangerous or otherwise improper use of the TeleNav Software in a moving vehicle, or from failure to follow the instructions above.

    2. User Account Information

You agree to: (a) provide TeleNav with true, accurate, current and complete information about yourself when registering for the TeleNav Software, and (b) promptly notify TeleNav of any changes to such information and keep such information true, accurate, current and complete.

    3. Software License

    • Subject to your compliance with the terms of this Agreement, TeleNav hereby grants you a personal, non-exclusive, non-transferable license (except as expressly permitted in connection with a complete transfer of the TeleNav software license), without the right to grant sublicenses, to access and use the TeleNav software (in object code form only). This license terminates upon termination or expiration of this Agreement. You agree that you will use the TeleNav software only for personal, business and leisure purposes and will not provide commercial navigation services to third parties.

    3.1 License Restrictions

    • (a) reverse engineering, decompiling, disassembling, translating, modifying, adapting or otherwise altering the TeleNav software or any part of the TeleNav software; (b) attempting to derive the source code, audio library or structure of the TeleNav software without TeleNav's prior express written consent; (c) removing or altering trademarks, trade names, logos, patent or copyright notices or other notices or markings of TeleNav or its suppliers from the TeleNav software; (d) distributing, sublicensing or otherwise transferring the TeleNav software to other persons, except in connection with your permanent transfer of the TeleNav software, or (e) using the TeleNav software in a manner that

    I. infringes intellectual property or ownership rights, publication rights, privacy rights or other rights of third parties,

ii. violates laws, regulations, ordinances or guidelines, in particular laws and regulations relating to spamming, data protection, consumer and youth protection, obscenity and defamation, or

iii. is harmful, threatening, abusive, harassing, unlawful, offensive, vulgar, obscene, defamatory or otherwise objectionable, or (f) lends, rents or otherwise gives unauthorized third-party access to the TeleNav software without TeleNav's prior written consent.

    4. Disclaimers

    • To the fullest extent permitted by applicable law, under no circumstances will TeleNav, its licensors and suppliers, or their representatives or employees assume liability for decisions you or third parties make in reliance on the information provided by the TeleNav software.

TeleNav makes no warranty as to the accuracy of maps or other data used by the TeleNav software.

Such data may not always reflect reality due to, among other things, road closures, construction work, weather, new roads and other changing conditions. You are responsible for all risks arising from the use of the TeleNav software. For example, but without limitation, you agree not to rely on the TeleNav software for critical navigation in situations where your well-being or survival or that of third parties depends on the accuracy of the navigation, since the maps and functionality of the TeleNav software are not designed for high-risk applications, particularly in remote geographic areas.
  • TELENAV EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER STATUTORY, EXPRESS OR IMPLIED, IN CONNECTION WITH THE TELENAV SOFTWARE, AS WELL AS ALL WARRANTIES ARISING FROM COURSE OF DEALING, USAGE OR TRADE, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
  • Some jurisdictions do not allow the exclusion of certain warranties, so this limitation may not apply to you.
  • 5. Limitation of Liability

    • UNDER NO CIRCUMSTANCES SHALL TELENAV OR ITS LICENSORS AND SUPPLIERS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES (IN EACH CASE INCLUDING, BUT NOT LIMITED TO, DAMAGES FROM THE INABILITY TO USE DEVICES, INABILITY TO ACCESS DATA, DATA LOSS, BUSINESS LOSSES, LOST PROFITS, BUSINESS INTERRUPTION AND THE LIKE) OR EXEMPLARY DAMAGES ARISING FROM OR RESULTING FROM THE USE OR INABILITY TO USE THE TELENAV SOFTWARE, EVEN IF TELENAV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
REGARDLESS OF ANY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES REFERRED TO HEREIN, AND ALL DIRECT OR GENERAL DAMAGES UNDER CONTRACT LAW OR BY INFRINGEMENT OF RIGHTS (INCLUDING NEGLIGENCE) OR OTHERWISE) THAT MAY ARISE FOR YOU FOR ANY REASON, THE LIABILITY OF TELENAV AND ALL SUPPLIERS OF TELENAV IS LIMITED TO THE AMOUNT YOU PAID FOR THE TELENAV SOFTWARE. CERTAIN STATES AND/OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

    6. Arbitration and Jurisdiction

    • You agree that all legal claims and disputes arising from this Agreement or the TeleNav software shall be resolved by binding arbitration before an independent arbitrator, administered by the American Arbitration Association in Santa Clara County, California. The arbitrator is required to apply the Commercial Arbitration Rules of the American Arbitration Association, and the arbitration award, including the compensation determined by the arbitrator, may then be submitted to a competent court. Please note that in the arbitration described above there is no judge and no jury, and that the arbitrator's decision is binding on both parties. You hereby expressly agree to waive your right to bring an action before a court with a jury. This Agreement and the services hereunder are governed by and construed in accordance with the laws of the State of California, USA, excluding its conflict-of-laws provisions. To the extent that court proceedings in connection with the binding arbitration award become necessary, TeleNav and you agree that they shall be heard exclusively before the courts of Santa Clara County, California, USA. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

    7. Assignment

    • Resale, assignment or transfer of this Agreement or any of your rights or obligations is not permitted, except in its entirety as part of a permanent transfer of the TeleNav Software, provided that the new user of the TeleNav Software agrees to the terms of this Agreement. Any sale, assignment or transfer not expressly permitted under this section will immediately terminate this Agreement without any liability to TeleNav. Upon such termination, you and all other parties must immediately stop using the TeleNav Software.
Notwithstanding the foregoing, TeleNav reserves the right to assign this agreement to third parties at any time and without prior notice, provided that the successor remains bound by this agreement.

    8. Miscellaneous

    8,1

This Agreement constitutes the entire agreement between you and TeleNav regarding the rights and obligations covered herein.

    8,2

Except for the limited licenses expressly granted in this Agreement, TeleNav retains ownership of and all rights in the TeleNav Software, including all related intellectual property rights. Except for the licenses and other rights expressly granted in this Agreement, no licenses or rights are granted or transferred, whether implied, by operation of law, by estoppel, by waiver or otherwise, and TeleNav and its suppliers and licensors hereby reserve all their respective rights (other than the license rights expressly granted in this Agreement).

    8,3

By using the TeleNav Software, you agree to receive all communications from TeleNav electronically, including notices, agreements and legally required disclosures, as well as other information (collectively, Information) in connection with the TeleNav Software. TeleNav may deliver such Information by posting it on the TeleNav website or by downloading it to your mobile devices. If you wish to withdraw your consent to receive Information electronically, you must stop using the TeleNav Software.

    8,4

A failure by TeleNav or you to enforce any performance provided for in a provision does not waive the right of the affected party to demand that performance at any time; likewise, a waiver of a breach or violation of this Agreement does not constitute a waiver of any further breach or violation or a waiver of the contractual provision itself.

    8,5

If any provision of this document is unenforceable, that provision will be modified to reflect the intent of the parties, and the remaining provisions of this Agreement remain in full force and effect.

    8,6

The headings in this Agreement are for reference and convenience only, are not part of this Agreement and will not be used to interpret this Agreement. The terms "include" and "including" and all their variations used in this Agreement are not to be read as limiting, but are to be understood as meaning "without limitation".

Entire Agreement. These terms constitute the entire agreement between Telenav (and its licensors and their licensors and suppliers) and you with respect to the subject matter of this agreement, and they supersede in their entirety any written or oral agreements previously existing between us with respect to this subject matter.

Distraction while driving can lead to loss of vehicle control, accidents and injuries.

We strongly recommend using these devices and their functions only with extreme caution, so that your attention is not diverted from the road. The safe operation of your vehicle is entirely your responsibility. We advise against using handheld devices while driving and recommend using voice-controlled systems where possible.

Make sure you are informed of all local laws that may affect the use of electronic devices while driving.

The voice guidance of the navigation system in the Ford Mustang (6th generation, 2014–2023) is designed to inform the driver clearly and in good time. Whether standard announcements or shortened prompts, the Ford Mustang 2014–2023 offers flexible settings that can be optimally adapted to personal preferences.

A particularly convenient feature is the ability to set the volume of the voice guidance independently of other audio sources. This keeps route guidance clearly audible even with loud music or an open window. The Ford Mustang 6th generation demonstrates its attention to detail and its high standard of operating convenience here.

    Frequently Asked Questions

Can I mute the voice guidance during navigation?

Yes, voice guidance can be turned off at any time through the menu or directly with the volume control.

How do I switch between full and shortened voice prompts?

This setting can be selected individually in the navigation menu under “Voice Options”.
